The agency can begin standard-setting procedures on its own initiative or in response to requests from the National Institute of Occupational Safety and Health (NIOSH), requests from state and local governments, any nationally recognized standards-developing organization such as American National Standards Institute, and National Fire Protection Association, employer or labor organizations, or any other interested person.

As a practical matter many states adopt standards identical to the federal regulations.
